1. Purpose and scope

These general terms and conditions of sale (hereinafter 'GTC') govern all transactions carried out on the website margotpourlavie.eu, whether they are memberships in the association or donations.

Any validation of a payment on the site implies full and complete acceptance of these Terms and Conditions.

2. Membership

The association offers two membership options:

• Annual membership : €20 per year, one-time payment. Valid for 365 days from the date of payment. No automatic renewal: members must actively renew their membership upon expiry.
• Monthly membership : €2 per month, per automatically renewing subscription. The subscription renews automatically each month and can be cancelled at any time.

Membership confers the rights defined by the association's statutes. The association reserves the right to modify membership fees, provided that members are informed in advance.

3. Donations

Donations made through the website are one-time payments, the amount of which is freely chosen by the donor, from €1 to €10,000. Donations can be made by individuals or businesses. A donation is a voluntary act of generosity, without direct compensation.

4. Payment terms

Credit card payments are processed by Stripe, a secure payment platform certified by PCI DSS. Payment is made by credit card (Visa, Mastercard, etc.). The association has no access to the payer's bank details at any time.

Donations can also be made by bank transfer. Bank details (RIB) will be sent by email after your donation intention has been registered. The donation is considered effective upon receipt of the transfer into the association's account.

Prices are shown in euros. The association is not subject to VAT in accordance with article 261-7-1° of the General Tax Code.

5. Right of withdrawal

Memberships

In accordance with Articles L221-18 et seq. of the French Consumer Code, members have a 14-day withdrawal period starting from the date of payment. To exercise this right, members must send their request by email to the association. The refund will be issued within 14 days of receipt of the request.

Donations

Since donations are voluntary acts of generosity towards a non-profit organization, they are not subject to the right of withdrawal provided for in Article L221-28 of the French Consumer Code. However, the organization may examine refund requests on a case-by-case basis.

6. Duration and renewal

• Annual membership : Valid for 365 days from the date of payment. No automatic renewal. The member must renew their membership upon expiry.
• Monthly membership : Subscriptions are automatically renewed each month. Members can cancel their subscription at any time. Cancellation takes effect at the end of the current billing period.

7. Cancellation of the monthly subscription

Members with a monthly subscription can cancel at any time by contacting the association via email. Cancellation takes effect at the end of the current billing cycle.

No pro-rata refunds will be issued for the current period. The association also reserves the right to terminate a subscription in the event of repeated payment failures.

8. Tax receipts

The Margot Pour la Vie association is recognized as being of general interest and is authorized to issue tax receipts for donations received.

• Individuals : tax deduction of 66% of the amount of the donation, up to a limit of 20% of taxable income (article 200 of the General Tax Code).
• Companies : tax deduction of 60% of the amount of the donation, up to a limit of €20,000 or 0.5% of turnover excluding tax (article 238 bis of the General Tax Code).

A tax receipt is sent by email after payment confirmation. Memberships do not entitle you to a tax receipt.

9. Protection of personal data

The personal data collected during membership and donation processes is necessary for processing transactions and issuing tax receipts. This processing is based on the performance of the contract (membership) and consent (donation).

The data is kept in accordance with applicable legal accounting and tax obligations (10 years for accounting documents).

10. Responsibility

The association cannot be held responsible for damages resulting from misuse of the site, interruptions related to maintenance or force majeure.

As payment processing is handled by Stripe, the association cannot be held responsible for malfunctions related to this service.

11. Applicable Law and Jurisdiction

These Terms and Conditions are governed by French law. In the event of a dispute, an amicable resolution will be sought first. Failing that, the competent courts of Reims shall have exclusive jurisdiction.

In accordance with European regulations, you can also use the European Commission's online dispute resolution platform, accessible at the following address: ec.europa.eu/consumers/odr.

12. Amendment to the General Terms and Conditions of Sale

The association reserves the right to modify these Terms and Conditions at any time. The applicable version is the one in effect on the website at the time the payment is validated. Users will be notified of any significant changes.
